How to Probate

May 12, 2017

The Klimas Law Firm offers probate services on flat fee and retainer basis. Handling this matter for our clients allows them time to process the difficult emotions with their family and friends instead of dealing with the court. Our primary goal is maintaining our high level of customer service and care to our clients.

The standard probate time can last anywhere from 6 months to 12 months. Not every day will require action but it is something that can get in the way of normal life. We aim to make the process as easy as possible and take the burden off of your shoulders. Beginning with the decision to file Formally or Informally, we asses and advise on the best possible course of action when it come so the Probate court. Check out our probate process page to learn more of the basic steps involved. Filing the JDF forms with the courts and getting you appointed personal representative is the first and most important step. The next step, and a very time intensive step, is getting the Estate inventory completed and all property and assets transferred into the estates name. From there an accounting is done to determine the total value of all assets included. Expenses and taxes can be paid from the estate as opposed to coming out of the personal representatives pocket. It is of incredible importance that this process be followed precisely as the Colorado Probate Code dictates, as it can lead to legal complications down the road if one or more of the steps are not complete.

Call Nick Klimas with any questions you may have about this process and rest assured that you are in good hands.
